Chapter One – Terms of Use and Legal Restrictions

1. Introduction and definitions
   1. Welcome to the website of the "Graco Baby" brand located at https://www.gracobaby.co.il (or any other address as may be changed from time to time) (hereinafter: the " Site "), operated and managed by "Bambino King Ltd.", C.P. 51492648, whose address is in the Tamra Industrial Zone, Israel (hereinafter: " Bambino King " or " Bambino " or the " Company ").
   2. The purpose of this Privacy Policy is to detail the manner in which the Company collects information on and/or about the users of the Site, as defined below, and how and for what purposes the Company collects such information. The document is written in the masculine form for convenience only, but refers to both genders.
   3. The privacy policy terms detailed below form an integral part of the Terms of Use. The Company may from time to time change the privacy policy and the Terms of Use, together or separately, to reflect technological, business, legal or regulatory changes. Updates to the aforementioned privacy policy will be published in this document, which will be found in its updated form in the application and on the website.
   4. Before using the Company's services, please ensure that you have read the terms of the Privacy Policy carefully and that you understand them. Your use of the Company's website, including browsing and/or purchasing, will be considered an express and informed consent on your part to all the terms, conditions and notices included in the Privacy Policy. If you do not agree to the terms of the Privacy Policy, in whole or in part, do not use the Company's services, including browsing the website and/or the application.
2. Settings
   1. " The Law " – the Protection of Privacy Law, 5741-1981.
   2. "The Services" or "Company Services" – all services provided to the user through the Company, both services that involve the delivery of information and services that do not involve the delivery of information, including through the Website.
   3. " Personal information " – means any data or information that you provide to the Company on a proactive basis on the Site in accordance with the purpose of your contact with the Company, which identifies or allows you to be identified personally (such as your name, your email address, your ID number, your payment method, etc.), as well as any information that constitutes "information" and/or "sensitive information" as defined by law.
   4. " Anonymous information" – means statistical information that does not identify or enable the user to be identified personally, which is linked to the end device on which the user uses the site and/or the application (such as how the site is used, the user's browser type, the date and time the user entered the site, etc.).
   5. "אתה" או "משתמש"; "החברה"; "שימוש  באתר" – כהגדרת מונחים אלה בתנאי השימוש, הזמינים לצפייה באתר
3. איסוף ושימוש במידע אישי

במסגרת השימוש באתר, אתה עשוי להידרש למסור והחברה עשויה לאסוף מידע אישי שלך או אודותיך באמצעים טכנולוגיים שונים. סוג המידע האישי שתמסור ו/או ייאסף על ידנו עשוי להשתנות, בהתאם לסיבה ו/או המטרה שלשמה אתה פונה אלינו. בעצם העלאת פרטי משתמש לאתר, הנך מצהיר, מתחייב ומסכים לאמור להלן:

1. פרטי המשתמש שתמסור באתר (אם וככל שתמסור) נכונים, מדויקים ושייכים לך.
2. ידוע לך כי לא מוטלת עליך חובה חוקית למסור לבמבינו פרטים או כל מידע אחר, ומסירת פרטי המשתמש נעשית בהתאם לרצונך החופשי. עם זאת, ידוע לך כי ללא מסירת פרטי המשתמש לא תוכל להשלים את הפניה לבמבינו באמצעות האתר ו/או את רכישת המוצרים באמצעות האתר, לפי העניין.
3. ידוע לך והנך נותן הסכמתך מדעת לכך שפרטי המשתמש ישמרו במאגר/י מידע של במבינו, ובמבינו תהא רשאית לעשות שימוש בפרטי המשתמש שמסרת באתר למטרות הבאות (כפי שיעודכנו מעת לעת):
   1. ככל שמסרת את פרטי המשתמש במסגרת "צור קשר באתר" – במבינו תעשה שימוש בפרטי המשתמש על מנת ליצור איתך קשר בנוגע לפנייתך;
   2. ככל שמסרת את פרטי המשתמש לשם  ביצוע הזמנה ו/או רכישה של מוצר באתר – במבינו תעשה שימוש בפרטי המשתמש לצורך השלמת הליך רכישת המוצר, חיוב בתשלום בגין המוצר, אספקת המוצר ומתן שירות בקשר עם המוצר, משלוח פניות בדיוור ישיר, שמירת הקשר איתך, ובכפוף להסכמתך – לצורך משלוח דברי פרסומת באמצעי מדיה שונים.
   3. בעצם העלאת פרטי משתמש לאתר, אתה מעניק לבמבינו רישיון שימוש לא בלעדי, בלתי מוגבל, בלתי חוזר ללא תמורה, לא כפוף לתשלום תמלוגים וללא הגבלת זמן בפרטי המשתמש, ובמבינו תהא רשאית לעשות בהם שימוש בהתאם למטרות המתוארות במדיניות פרטיות זו, כפי שיהיו מעת לעת, ולא תהיה לך כל תביעה ו/או טענה ו/או דרישה (כספית או אחרת) כלפי במבינו בשל כך. פרטי המשתמש יישמרו על שרתי יעקבי, בישראל.
4. העברת מידע לצדדי ג'

החברה עשויה להעביר מידע אודתייך לצדדים שלישיים, מעת לעת, במקרים שיפורטו להלן, ו/או בכל מקרה אחר בו תידרש העברה, לרבות העברת מידע אל מחוץ לגבולות ישראל :

1. לחברת השליחויות לשם אספקת המשלוח לצרכן (ככל שהצרכן בחר לקבל את ההזמנה באמצעות חברת השליחויות).
2. בנסיבות של שינוי בעלות ו/או שינוי שליטה.
3. כמענה לבקשה או פנייה של רשויות מוסמכות בישראל או מחוץ לישראל ו/או עפ"י צו בית משפט ו/או ככל שהדבר נדרש לצורך הגנה על זכויות החברה ונכסיה ו/או ככל שמסירת מידע כאמור מחויבת עפ"י כל דין, וזאת אף מבלי שתהיה חייבת ליידע אותך לפני ביצוע הדיווח ו/או לאחר מכן, לפי שיקול דעתה.
4. מבלי לגרוע מכל האמור, במבינו תהא רשאית להעביר מידע אנונימי לצדדי ג' כמפורט בסעיף ‏5 להלן, ללא מגבלה. מאחר ומדובר במידע שאינו מזהה אותך באופן אישי, אתה פוטר את במבינו מכל תביעה ו/או דרישה ו/או טענה בשל כך.
5. המידע שחברת במבינו אוספת נשבר על שרתים בענן ועשויים לעבור מחברה אחת לאחרת ללא הודעה או עדכון עבור המשתמש
6. איסוף ושימוש במידע  לא  אישי
   1. כאשר אתה עושה שימוש באתר, החברה אוספת מידע הנשלח אליה על ידי המחשב, טלפון נייד או מכשיר אחר בו אתה משתמש לצורך השימוש באתר ו/או באפליקציה, שהינו מידע אנונימי, היינו - שאינו מזהה אותך באופן אישי ואינו ניתן לשיוך אליך.
   2. המידע האנונימי הנשלח אלינו עשוי לכלול, בין היתר: נתונים על הדפים בהם משתמשים ביקרו, סוג מכשיר, פרטי מחשב וחיבור, פרטי רשת למכשירים ניידים, נתונים סטטיסטיים על צפיות בדפים, תעבורה אל האתר וממנו, כתובת URL ממנה הגולש הגיע לאתר וכו'. [לאישורכם].
   3. החברה מנתחת ועושה שימוש בעצמה או באמצעות מי מטעמה במידע אנונימי למטרות המפורטות להלן (כפי וככל שישתנו מעת לעת): (א) הערכת האופן שבו המשתמשים משתמשים באתר לצורך ניהול, שיפור וקידום האתר; (ב) תיקון תקלות; (ג) שיפור חווית השימוש באתר; (ד) ניתוח ופילוח דפוסי גלישה באתר; (ה) התאמת מודעות פרסומת בהתאם להרגלי גלישה; (ו) כל מטרה חוקית אחרת כפי שנמצא לנכון.
   4. יתכן ותוכל למחוק או לנטרל או לחסום כלים אלה (תלוי בסוג הדפדפן שלך), אך אם תעשה כן יתכן והדבר יפגע ביכולת שלך לעשות שימוש באתר. אם וככל במבינו תאסוף מידע משתמש באמצעות כלים כאמור לעיל, האיסוף יבוצע בכפוף להסכמתך. בכל בקשה לקבל מידע נוסף ניתן לפנות באופן ישיר לחברת במבינו תחת הלשונית "צור קשר" באתר .
7. עוגיות (Cookies) [לבדיקת איש אבטחת מידע]
   1. עוגיות הן קבצי טקסט אשר הדפדפן או האפליקציה של המשתמש יוצר לפי פקודה ממחשבי החברה. חלק מהעוגיות יפקעו כאשר תסגור את הדפדפן או את היישום הרלבנטי, ואחרות נשמרות על גבי זיכרון המכשיר או המחשב שלך.
   2. לידיעתך, לצורך אספקת חלק מהשירותים החברה משתמשת בתוכנות צוברות מידע, כגון עוגיות,  דוגמא- pixels, tags beacons] (להלן יחדיו יכונו בשם הגנרי "Cookies" ו/או "עוגיות") לצורך תפעולם השוטף והתקין, לשם אבטחת הנתונים בהם והמידע הנמסר, ובכלל זה כדי לאסוף נתונים סטטיסטיים אודות השימוש בשירותים, לשם קבלת החלטות בנוגע לשירותים ו/או פעילותך, לשם אימות פרטים וזיהוי, מניעת הונאות ותרמיות, לשם שיפור חווית הגלישה, תוך התאמת התכנים והשירותים להעדפותיך האישיות, לשם אפיון המוצרים המתאימים לך, להתאים עבורך פרסומות הרלבנטיות אליך, אף בגלישתך באתרים אחרים, הכל למטרות סטטיסטיות, מחקריות, שיווקיות ומסחריות, וכמובן לצרכי אבטחת מידע.
   3. העוגיות מכילות ואוספות מידע מגוון כדוגמת הדפים שבהם ביקרת, משך הזמן ששהית באתר ו/או באפליקציה, מהיכן הגעת אל האתר ו/או הדף, כתובת ה-IP שלך, מאפייני המכשיר שלך, ומידע שתבקש לראות בעת הכניסה לאתר ועוד. כמו כן יכול והעוגיות ישמרו אף מידע בדבר הרגלי הגלישה שלך באתרים אחרים, לרבות האתרים בהם גלשת, העמודים באתרים/באפליקציה וכל פעולה אחרת בהם. המידע בעוגיות מוצפן, והחברה נוקטת צעדי זהירות כדי להבטיח שרק מחשביה או מי מטעמה יוכלו לקרוא ולהבין את המידע האגור בהם.
   4. השירותים עשויים לעשות שימוש אף בעוגיות צד ג' כגון חברת גוגל, פייסבוק ואחרים.
8. אבטחת מידע
   1. לצורך יצירת אזור אישי באתר ו/או באפליקציה, עליך להזין, בין היתר, סיסמא בהתאם להנחיות המופיעות באתר ו/או באפליקציה. הנך אחראי לשמירת סודיות הסיסמא ואינך רשאי להעבירה ו/או לאפשר לגורם אחר לבצע שימוש בשם המשתמש והסיסמא ו/או בחשבונך. הנך נדרש לדווח לחברה על כל שימוש לא מורשה בפרטיך.
   2. לתשומת ליבך, כל כניסה לאתר ו/או לאפליקציה שתיעשה באמצעות פרטיך המזהים (למשל – מספר ת.ז. ו/או הסיסמא שלך (לרבות כל מידע אישי שיימסר תוך שימוש בהם) תיחשב ככניסה שבוצעה על ידך, ואתר פוטר את החברה וכל מי מטעמה מכל חבות או אחריות לשימוש בלתי מורשה שיעשה בשם בפרטיך, ולתוצאות השימוש כאמור.
   3. The Company uses generally accepted information security technologies, and will make reasonable efforts to ensure that the Site and/or Application are free and clean from viruses, worms or Trojan horses. The Company will operate and implement generally accepted procedures in the market to secure your personal information from unauthorized access, use or disclosure. However, it is known that despite the above, this does not provide absolute security with respect to the information you provide to the Company (whether actually stored in the Company's information systems or stored and archived with a cloud provider(s).
   4. Therefore, it is your responsibility to take basic protective measures on your computer or the end device you use (including installing antivirus software, locking your computer, changing passwords, etc.), in order to protect your personal information.
9. Information retention, right of access, correction and deletion of information
   1. As a general rule, personal information from you or about you will be retained in the Company's database(s) for the period of time necessary for the Company to provide the services requested by you, as applicable, and as long as the Company has a legitimate need or legal or other obligation to retain it under any law. Anonymous information will be retained in the Company's information systems indefinitely (as long as this is not prohibited by any law).
   2. You are entitled to review the personal information held about you in the Company's database(s), to the extent that it is retained, and to request that the information be corrected or deleted, by sending a request to the Company by email at  info@bambinok.com.  We will act to fulfill your request in accordance with the information required of us by law. However, personal information that the Company needs to continue to conduct its business and/or that is needed for a legitimate purpose, such as defending against claims (and all, to the extent necessary) will continue to be retained by the Company for the period of time required by law.
10. Advertising . To the extent that you have indicated on the site that you agree to receive updates and/or advertising or marketing materials from Bambino, you hereby agree that Bambino will send you from time to time advertising and/or marketing material about Bambino and/or the products and/or services offered by it to its customers through various media, including email, SMS, WhatsApp, where this consent constitutes consent to receive advertising according to the Communications (Telecommunications and Broadcasting) Law, 1982. You may withdraw your consent to receive advertising at any time by sending a request to  info@bambinok.com
11. Contact us . You are welcome to contact us with any questions, requests or problems related to the privacy policy by contacting us via the email address info@bambinok.com and we will make every effort to get back to you regarding your inquiry as soon as possible.
12. Minors . The Site is intended for use by adults (over the age of 18) within the jurisdiction of the State of Israel, and is not intended for minors. If you are a minor (under the age of 18), your use of the Site will constitute evidence that you have received permission from your legal guardian appointed for you to make such use.
